Terms of Service

These Terms govern your use of To Myself (the "Service"), provided by Mark Maples ("we," "us"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use To Myself. If you are between 13 and the age of majority in your jurisdiction, you confirm that you have permission from a parent or legal guardian to use the Service. If you are using the Service on behalf of an organization, you confirm you have authority to bind that organization to these Terms.
2. Your account
You are responsible for keeping your sign-in credentials secure and for all activity under your account. Notify us at support@tomyself.app if you suspect unauthorized access. You may close your account at any time from Settings; closure deletes your data as described in our Privacy Policy.
3. Your content
You own everything you write. Your journal entries, reflections, virtue tags, and any other content you create remain your intellectual property. We claim no ownership interest in your entries.
You grant us a limited, non-exclusive license to store, transmit, display back to you, and process your content solely for the purpose of providing the Service to you. This license ends when you delete your content or your account. We do not use your content to train AI models, sell to third parties, or display to other users.
4. The Stoic Tutor and AI features
To Myself includes AI-assisted features, including a Stoic Tutor that responds to your recent entries. When you use these features, you understand that:
- Your recent entries will be sent to our AI processor (Anthropic, PBC) to generate responses.
- The AI processor does not train its models on your data under the terms of our agreement with them.
- AI responses are generated automatically and may be inaccurate, incomplete, or inappropriate to your situation. They are not advice and not a substitute for human judgment or professional care.
- You can choose not to use AI features, in which case no entry content leaves our infrastructure for AI processing.
5. Not therapy or medical advice
If you are experiencing a mental health crisis, having thoughts of self-harm, or otherwise in distress, please contact a qualified professional or emergency service:
- United States: dial or text 988 (Suicide and Crisis Lifeline), or visit 988lifeline.org.
- International: find your local crisis line at findahelpline.com.
- Emergencies: dial your local emergency number (911 in the US, 112 in the EU, 999 in the UK).
6. Acceptable use
You agree not to:
- Use the Service to violate any law or the rights of others.
- Reverse engineer, scrape, or otherwise attempt to access source code or systems beyond the interfaces we provide.
- Attempt to access another user's account or content, or interfere with the Service's operation.
- Use the Service to upload malware, transmit unsolicited communications, or engage in any abusive behavior toward us or other users.
- Resell, sublicense, or otherwise commercially exploit the Service without our written permission.
We may suspend or terminate accounts that violate these rules. We will give you notice and a chance to export your data unless the violation requires immediate action.
7. Subscriptions and payment
The core journaling features of To Myself are free. Some future features (such as the Stoic Tutor) may be offered as a paid subscription. If you subscribe:
- Subscriptions are billed through the Apple App Store or Google Play. Their billing terms apply in addition to ours.
- Subscriptions auto-renew until canceled. You can cancel anytime through your platform's subscription settings; cancellation takes effect at the end of the current billing period.
- Refunds are handled by the platform (Apple or Google) under their respective policies. We do not process refunds directly.
8. Intellectual property
The To Myself name, logo, app design, written prompts, curated passage selection, and software are owned by us. You may not copy, distribute, or create derivative works from these without our written permission. The underlying public-domain works of Stoic authors quoted in the app are not subject to this restriction.
9. Changes to the Service
We may add, change, or remove features over time as the product evolves. We will give you reasonable notice of any change that materially reduces functionality you rely on. We may end the Service entirely with at least 30 days' notice and an opportunity to export your data.
10. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, secure against every threat, or that any content (including AI-generated content) will be accurate or suitable for your purposes.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, or punitive damages — or for lost profits, lost data, or business interruption — arising from your use of the Service. Our total aggregate liability for any claim arising from or related to the Service is limited to the greater of (a) the amounts you paid us in the 12 months before the claim arose, or (b) US $100.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (for example, gross negligence, fraud, or consumer protection rights).
12. Indemnification
You agree to indemnify and hold us harmless from any claim brought by a third party arising from your content, your violation of these Terms, or your misuse of the Service, except to the extent caused by our gross negligence or willful misconduct.
13. Termination
You may stop using the Service at any time and delete your account from Settings. We may suspend or terminate your access if you materially violate these Terms, after notice where reasonable. Sections that by their nature should survive (e.g., ownership, disclaimers, limitation of liability, governing law) survive termination.
14. Governing law and disputes
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved in the courts of Alameda County, California, except where applicable consumer-protection law gives you the right to bring claims in your local courts. Nothing in this section limits any non-waivable rights you have as a consumer.
15. Apple App Store additional terms
If you obtained the app through the Apple App Store, the following additional terms apply:
- These Terms are between you and us, not Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Beyond that, Apple has no warranty obligation.
- Apple is a third-party beneficiary of these Terms and may enforce them against you.
16. Changes to these Terms
We may revise these Terms as the Service evolves. If we make material changes, we'll notify you in the app or by email and update the "last updated" date. Continued use of the Service after notice constitutes acceptance of the revised Terms. If you don't agree, you can stop using the Service and delete your account.
